Sunan at-Tirmithiy كتاب الطلاق واللعان باب ما جاء فى الجد والهزل فى الطلاق

حَدَّثَنَا قُتَيْبَةُ حَدَّثَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَرْدَكَ عَنْ عَطَاءٍ عَنِ ابْنِ مَاهَكَ عَنْ أَبِى هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ثَلاَثٌ جِدُّهُنَّ جِدٌّ وَهَزْلُهُنَّ جِدٌّ النِّكَاحُ وَالطَّلاَقُ وَالرَّجْعَةُ. قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِىِّ صلى الله عليه وسلم وَغَيْرِهِمْ. قَالَ أَبُو عِيسَى وَعَبْدُ الرَّحْمَنِ هُوَ ابْنُ حَبِيبِ بْنِ أَرْدَكَ الْمَدَنِىُّ وَابْنُ مَاهَكَ هُوَ عِنْدِى يُوسُفُ بْنُ مَاهَكَ.
The Messenger of God, peace and blessings of God be upon him, said, “Three matters to be taken seriously whether in earnest or in jest: marriage, divorce, and taking back a wife (after a divorce that is not final).”(1) Footnotes: 1- The purpose of this is to affirm the seriousness of the three issues mentioned in the ḥadīth. If all people were to treat these matters lightly and undertake them in jest, the rulings set by Allah regarding them would be nullified. Thus, it does not matter if a person says, "I was only joking," as he will be accountable for the ensuing effects of what he has uttered in this regard. In such cases, the rulings concerning marriage or divorce or taking back a wife will be valid and effective.
